Terms of Use
The agreement between you and Upheld Health, including the terms of our text messaging program.

1. Agreement
These Terms of Use govern your use of this website and of Goldie, a text-first care companion provided by Upheld Health Technologies (“Upheld Health,” “we,” “us”). By using either, you agree to these terms. If you do not agree, please do not use them.
Our Privacy Policy explains how we handle information and forms part of these terms.
2. Who may use Goldie
You must be at least 18 years old and able to form a binding contract. Goldie is intended for adult caregivers managing care for themselves or someone else.
Goldie is currently in development. Access is limited to participants we have invited, and features may change, pause, or be withdrawn while we are building and validating the service.
3. Text messaging program
- Consent. Goldie is currently offered through an invited pilot. Caregivers who take part enroll affirmatively and consent to receive text messages from Goldie at the mobile number they provide. Consent is not a condition of purchasing any goods or services.
- Message frequency. Message frequency varies, and depends on the reminders and preferences you set.
- Cost. Message and data rates may apply, charged by your mobile carrier.
- Opt out. Reply STOP at any time to stop messages. We will send a single confirmation and stop.
- Help. Reply HELP, or email katelyn@upheldhealth.org.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Supported carriers. Carrier support may change, and we cannot guarantee delivery on every network.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, and will never be sold or shared with lead generators.
4. Goldie does not provide medical advice
Goldie remembers, retrieves, organises and reports the information you give it. It does not diagnose conditions, recommend treatment, or make medical decisions, and nothing it says is medical advice.
You and your care team remain responsible for every medical decision. Do not delay seeking, or disregard, professional medical advice because of something Goldie said.
Goldie is not an emergency service. If you have a medical emergency, call 911 or your local emergency number, or contact your care team directly.
5. Reminders are an aid, not a guarantee
Goldie is designed to help you keep track of things. It depends on information you give it, on mobile networks we do not control, and on software that can fail. Reminders may be delayed or may not arrive.
You remain responsible for administering medication, attending appointments, and following your care team’s instructions. Do not rely on Goldie as your only safeguard for anything that matters to someone’s health or safety.
6. Your responsibilities
- Give accurate information, and keep it current.
- Use Goldie only for lawful purposes and only for care you are entitled to be involved in.
- Do not use Goldie to harass, abuse, or impersonate anyone.
- Do not attempt to disrupt, reverse engineer, or gain unauthorised access to our systems.
- Keep your device secure. Messages remain readable by anyone who can open your phone.
7. Our intellectual property
Upheld Health owns this website, the Goldie service, and the names, logos, text, graphics and software in them. The underlying technology is Patent Pending. These terms do not give you any right to use our names or marks.
You keep ownership of the information you provide. You give us permission to use it to operate the service for you as described in our Privacy Policy.
8. Disclaimer of warranties
The website and Goldie are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error free, or that information will always be accurate.
9. Limitation of liability
To the fullest extent permitted by law, Upheld Health will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of the website or Goldie.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Ending your use
You may stop using Goldie at any time by replying STOP or by asking us to close your account. We may suspend or end access if you breach these terms, or if we discontinue the service.
11. Changes
We may update these terms. If changes are material, we will update the date at the top of this page and give notice where appropriate. Continuing to use the service after a change means you accept the updated terms.
12. Governing law
These terms, and any dispute arising out of or relating to them or to your use of the website or Goldie, are governed by the laws of the State of Georgia, without regard to its conflict of laws principles.
Any such dispute will be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts.
